A History of Safeguarding Children and Families

I have been board certified in Marital and Family Law since 1993. Helping to make sound child custody decisions, I have been appointed by the courts to serve as Guardian ad Litem.

Keeping Current with Changes in the Law

Pursuant to the recent changes in Florida Statute Chapter 61, I am prepared to help you and your child's other parent establish a parenting plan that correlates with the recent changes to the Florida shared parenting statute (Ch. 61.13).

The terms Child Custody and Visitation are now being eliminated, and "time sharing" is being substituted in its place. Gone are the labels of primary residential parent and secondary residential parent. All presumptions have been removed. The law now requires that a proposed parenting plan be created and presented to the court when appropriate. Parenting plans must include a time sharing schedule that clearly states the time a child will be with each parent.

The law requires more collaboration and cooperation between parents in creating a plan that is the best interests of their child. If parents cannot agree and do not create a time sharing plan on their own, the court will determine one. If the court determines a custodial plan, there are set factors it must take into account.

Parents in Florida will be empowered to spend less time and money in fighting over labels, thus losing the animosity and hopefully allowing parents to create plans for their children that will allow for success after the break‑up.

Modifications, Enforcement and Relocation

Modification of a custody order requires a substantial change in circumstances. Enforcement comes up when one party is not following the agreed upon court order. Relocation of a parent can cause a major impact on time sharing. Refer to Chapter 61, Florida Statutes for more information.
