Miami Heat Player Chris Bosh Seeks Primary Custody of Daughter

Miami Heat basketball star Chris Bosh has filed paperwork seeking primary physical custody of the 4-year old daughter he shares with his ex-girlfriend. The papers seem to suggest that Bosh believes his ex-girlfriend is an unfit parent. It has been suggested that the mother of the child may not be fostering Bosh's relationship with the child. Bosh's request for primary physical custody also comes with an offer of visitation to his ex-girlfriend. There has been recent acrimony in the case related to the ex-girlfriend's request to have the child support she receives increased from $2,600 a month to $30,000 a month and controversy concerning Bosh's residency status in Texas versus Florida.

The meaning of physical custody in child custody disputes and situations is that the child will live with the parent who has physical custody of the child. The parent with physical custody is commonly referred to as the custodial parent and the other parent typically shares legal custody with the custodial parent. The non-custodial parent commonly enjoys visitation of the child. Historically, joint custody was a little more common, wherein the parents shared physical custody half of the time. To minimize disruption to a child's life, one parent is now more commonly given physical custody of the child.

Giving one parent physical custody and the other parent visitation rights, rather than having the child share its time between both parents, is considered somewhat more in the best interests of the child. Sole custody is when one parent has both physical and legal custody of the child. Such custody arrangements are rarer and are found in cases when a parent has been found to be an unfit parent. This occurs in cases of drug addiction or child abuse, for example.
