Woods's Recent Behavior may Violate Divorce Agreement

It is important to allow the legal process perform its designated functions during a divorce dispute.

Tiger Woods recent trip out on his yacht and to his children's school in Florida with his new girlfriend appears to have created some controversy with his ex-wife. It seems that according to the couple's divorce agreement, the couple's two children are to be kept at a distance from romantic interests and attempts at publicity. The question is if these supposed violations of the couple's divorce agreement will bring the divorce back into court; the suggestion has been made the Woods's ex-wife will seek an injunction against Tiger's behavior that she considers in violation of the agreement.

Most divorce agreements are arrived at between the parties prior to the need to go to court. The agreement will typically either be settled upon between the parties or through alternative dispute resolution options such as mediation. Usually, the parties will reach an agreement which will be written down and presented to the judge. A hearing will likely follow, during which the judge will ask some basic questions to ensure both parties understand the agreement and voluntarily enter into it. Provided the judge is satisfied by the fairness of the agreement and the process used to reach it, the judge will approve the agreement.

If the judge does not approve of all or a part of the couple's divorce agreement, the judge will instruct the parties to continue negotiating on those specific terms; if the couple is unable to reach an agreement, the issues will go to trial. Important divorce legal issues such as child support and child custody are part of a divorce agreement. The issues, as well as enforcement of terms of a divorce agreement, can take the couple back to court if an agreement modification is sought. Post-divorce modifications may be available based on a variety of factors as circumstances arise or changes in the lives of the parties occur.

It is not surprising that divorce disputes create strong emotions. In the midst of divorce-related situations, it can be helpful to keep in mind that the court maintains as its goal fairness to the parties in resolving disputes.
